Terms of service
Last updated 13 October 2026. Version 0.1 (draft). These terms apply to businesses; Popagain is not offered to consumers.
1. Who these terms are between
[Company name] trading as Popagain, company number [number], registered at [address] ("Popagain", "we"), and the business that creates an account ("you"). By ticking the box at sign-up, or by using the service, you agree to these terms and to the data processing agreement, which forms part of them.
2. The service
Popagain sends your customers a message after a visit asking for an honest public review, with a link to your review page; sends one reminder if the link is not opened; stops on a reply or an opt-out; shows you what was sent, opened and replied; flags replies that need your attention and drafts responses for you to approve; and provides the connections, reports and tools described on the dashboard. The service is described in more detail at popagain.uk and may change over time as we improve it.
Popagain does not and cannot guarantee that any customer will leave a review, or what they will say. Reviews are the customer's own.
3. Your account
- You must give accurate details and keep them up to date, including the alert email address.
- You are responsible for everyone you give a login to. Disable a login the day someone leaves.
- Keep API keys, calendar links and the email-forwarding address secret. Anyone who has them can add visits to your account.
4. Your obligations about your customers
You are the controller of your customers' data. You confirm that:
- you have a lawful basis to contact each customer you send us, and that doing so is consistent with your own privacy notice (we give you suggested wording in the compliance pack);
- you will send us only what the service needs: a first name, a mobile number or email address, and the time of the visit. You will not send clinical, treatment or other special-category details; if your business handles health data, you confirm you have completed a data protection impact assessment before onboarding;
- you will act on opt-outs and complaints that we pass to you;
- you will not use the service to send anything other than the review request and reminder it is designed for.
5. Review integrity: things neither of us will do
These are conditions of the service. Breach of any of them lets us suspend or end your account immediately (section 11).
- No gating. Every customer receives the same public review link. You will not ask us to send requests only to customers you expect to be positive, and the service will not route unhappy customers away from your public page. This is prohibited under the Digital Markets, Competition and Consumers Act 2024 and by Google's policies.
- No incentives tied to a review. Nothing you offer a customer may depend on them leaving, changing or removing a review. Our messages never mention offers, discounts, money or ratings, and our software blocks wording that does.
- No fake reviews. Neither of us will write, buy or generate reviews.
- No disclosure in public replies. Suggested replies to public reviews are generic by design; you will not edit them to confirm that a reviewer is a customer or to mention their visit.
6. Fees, billing and the 30-day refund
- Fees are the monthly amount for the plan you chose, shown excluding VAT, billed monthly in advance by card through our payment provider.
- Each plan includes a monthly number of requests. If you exceed it for two months running we will contact you to move you to the right plan; we do not charge overage without agreeing it with you.
- 30-day refund. If you cancel within 30 days of your first payment, for any reason, we refund that payment in full. Email us or use the billing portal.
- You may cancel at any time from the billing portal with no notice period; the service continues to the end of the paid month. We do not refund part-months after the first 30 days.
- We may change prices with 30 days' notice by email. The change applies from your next renewal after the notice period.
7. The delivery guarantee
If in any calendar month we fail to send a review request to a customer you gave us who had a valid, deliverable mobile number or email address, had not opted out, and whose visit was given to us within the lateness window shown in your settings, within 24 hours of the scheduled send time, that month is free: tell us within 14 days of the month end and we will credit or refund the fee for that month. The guarantee covers what we control. It does not cover delays caused by your quiet hours, a carrier or email provider rejecting a message, an invalid number, or a visit given to us late. It does not promise any number of reviews.
8. Availability and support
We aim for the service to be available at all times and tell you about planned maintenance in advance, but we do not offer a service-level guarantee. Support is by email at hello@popagain.uk during UK business hours, and we respond within one working day. Plans marked "priority support" are answered first.
9. Intellectual property and your data
We own the service and everything in it. You own your data and the content of your messages. You give us the licence we need to run the service on your behalf. Statistics derived from use of the service that do not identify you or your customers are ours.
10. Liability
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited by law.
- Subject to that, our total liability to you under or in connection with these terms in any 12-month period is limited to the fees you paid us in that period.
- We are not liable for loss of profit, loss of business, loss of reputation, or indirect or consequential loss, nor for the content of any review a customer leaves.
- You indemnify us against claims arising from your breach of section 4 or 5.
11. Suspension and termination
- You may end these terms at any time by cancelling (section 6).
- We may suspend or end the service immediately if you breach section 4 or 5, if a payment fails and is not resolved within 14 days, or if we are required to by law. Otherwise we may end these terms on 30 days' notice.
- On termination we stop sending, keep your data for 90 days in case you return, then delete it as described in the privacy notice. The opt-out list is retained because the law requires us to honour opt-outs.
12. General
- We may update these terms. We will email the alert address on the account at least 30 days before a material change takes effect; continuing to use the service after that date is acceptance.
- These terms are governed by the law of England and Wales and the courts of England and Wales have exclusive jurisdiction.
- If any part is unenforceable the rest stands. Neither of us is liable for failure caused by events outside our reasonable control. These terms, the data processing agreement and the plan you chose are the whole agreement between us.
